I am trying to help out my girlfriend who is in a situation that seems to be getting worse.

She moved in with 3 friends into a house about 4 months ago and everything has been going fine. Just last week some personal issues arouse within the house and tentions got really high.

My girlfriend recieved a hand written eviction notice from a roomate (not from a court) saying that she needs to get out by the end of the month which was less than a week. They have demanded to leave her doors unlocked so they can show off the room to potential roomates.They have also sent threatening messages to her saying that if she is not gone they are going to break the doors down and throw all her stuff on the lawn.

My girlfriend decided to avoid the possibily of having her possesions destroyed/stolen and moved out within a day which was the 25th of Sept. She is currently trying to find a storage facility and is staying with me till she finds a place to live.

She is not on the lease. She just took over for a roomate that left.

What can we do about this? is there any legal ground to sue? Also, they have been slandering her name and making her look really bad to everyone. Is there grounds to sure for defamation?

After reading tons of post's I thought I would clarify :

* There are 3 roomates. One of them is on the lease.

* They have threatened to break in and change the locks via myspace/ text messaging/ verbal.

* There was no contract when she moved in. Just pay rent/utilities.

* They have been slandering her name throughout all of our friend networks and causing scenes virtually everywhere they go and causing her a great deal of pain and suffering.

What they did was illegal. It's called self help eviction. Your girlfriend has grounds to sue.

I'd cut and paste copies of everything they said about her on myspace to take to court. Whether or not it's slanderous is something that the court will have to decide.

Out of curiosity, what does the landlord say?

She has not had any contact with the landlord. I dont believe the LL knows she was a tenant. Can that be a problem?

The latest info changes things. If the landlord didn't know about your girlfriend, chances are the tenant who signed the lease didn't have permission to sublet. If that's the case, and your girlfriend has been living there illegally for four months, on what grounds will she sue?

She should worry less about her image and more about the landlord.
