My landlord in San Jose, CA has given me a thirty day notice. I have been on a month to month lease for two years. Two weeks ago, a faulty toilet caused the apartment to flood. There was extensive damage that was the fault of the equipment not mine. He said he did not want to report this to his insurance company because of other claims he has made on other apartments might cause the company to drop his coverage.
When he gave me the notice he said the damage was going to cost him a lot of money out of pocket. He said he couldn't legally raise my rent due to rent control but by evicting me he could get at least $500 more per month rent from the next tenant which would alleviate his costs. He said I was a good tenant and he didn't want to evict me and my children, that we are good tenants, but had no choice. He suggested that if I pay half of the repair costs, he might be able to let us stay.
It seems to me he is just trying to avoid rent control regulations. Do I have any legal recourse to keep this apartment and avoid eviction.
