let your lawyer do that.....it should have been part of he agreement lawyers work out as they go thru the legal process.
BUT you will have to trade something to get him out peacefully, thats the way it works....horse trading..
the house may be considered joint marital assets, and he would have just as much rights as you do to live there, the lawyer would know
So you may have to trade not getting his retiremnt money in exchange for him moving out, because he now has to pay rent, you know horse trading.
Next time have a pre-nupital agreement, such as the house is not to be considered a martial asset, then it would be a piece of cake to get him out..
