I live in a little village, my husband and I rent out our old home for a cheap price. The tenant's that have been there for the last 15 months were made to sign a agreement when they moved in. Stateing that the rent was due on the first of every month.Which they only done on 4 occations, and once they had to split the rent payment into two payments one of $200 and another a week later of $150.
We would like to know how to go about evicting them, there about 5 other things that we have problems with them about.
Any advice is good. I forgot to say that we live in Ontario CANADA.

Chances are it wont be easy if they have a lease.....the rent is paid up...ok not how you like it, but it is PAID, and no judge will evict a paying tenant.

Now if they have no lease, or it expired, then they are month to month tenants and all you have to do is give them a 30 day notice to move by the 1st. and if they are not out by March 1st they are a holdover, etc, and you can start legal eviction procedings.

Also to avoid any problems, pay them back their secuirty i full ..yeah you may lose a few dollars but good riddance!

If they have a valid lease the only way to get them out is if YOU PAY THEM to move!

Offer them next months free rent, there security back, and say a few hundred for moving expenses, get it in writing and ....... good riddance!

You have hurt yourself a little by continuing to allow them to abuse your kindness. Once they found out that you were going to 'foregive' their rent, they have continued to do so.

In any case, do you have a written lease. If so, what does it say about eviction??

If eviction is not mentioned, you need to contact your local county court system and see what needs to be done to evict your tenants. While doing that, send them a WRITTEN notice to vacate. Give them a reasonable amount of time (10 days??). If they don't vacate voluntarily, you will need to start legal proceedings to get them to leave.
