Im asking this question for my sister because she has no internet right now ..She is going through a hectic divorce and is wonder if her spouse can evict her own mother from the hosue they live in now? She went their to keep the peace between the two and now he's trying to get her evicted ..is that possible?

Who is going to retain possession of the house?

they're selling the house after the divorce is final, so I would assume nobody ..but she's waiting for the judge to finalize things so she can get out there and leave hawaii

Then her mother needs to be looking for somewhere else to live anyway....and they really ought to get the home on the market now.

No, he can't kick her out because you are right, its her house too. However he can make things very unpleasant.

yeah and thats exactly what he's been doing. he starts fights, makes things hectic there and causes as much trouble as he can just to give them a hard time but they let him do what he wants because they just want him to do the things he's suppose to do so she can get out of their but he keeps putting things off. They both hate each right now and he seems to not want to sign things and let her get out of their just because he seems to enjoy causing them heartache more. Its like he gets off on it and would rather have them their so he has someone to bug. She don't want to leave until things are signed and she has possesion of her things, she's afraid if she leaves he'll do something to her belongings or he'll make sure when the movers come that not everything gets sent and since she's in hawaii its not like she can just load things up and drive out of their.

She is wise to stay put until she can get her things packed up and moved herself. However, it would also be wise not to leave Hawaii until the house has been sold and she has her share of the proceeds. Which is why it really should be on the market now, rathering than waiting for the divorce to be final.

He could delay the sale of the house for a every long time if he wanted to do that....or he could not pay the mortgage and cause the house to be foreclosed upon. People have been known to be that stupid when they are angry about a divorce.

Storage unit.
In mother's name.
Movers can move stuff from storage, and she doesn't have to even be there.
Removing items might light a fire under stbx to stop delays.
