I live in Massachusetts and was given a notice to terminate tenancy dated Nov 17, 2000 and effective Jan 1, 2001. No reason on notice, no rent overdue. I called my landlord to ask why, he said it was because other tenants complain that I am loud. The landlord agreed its cuz I work til 12:30AM. Since the house was originally 1 family you can hear what everyone is doing (like someone coughing!). I do not have parties, it's just the noise of living. The landlord said as long as there were no more complaints he wouldn't evict and to let him know what I would do. Heard nothing til Jan 5 I was given a summary process to go to court for eviction because I "failed to comply with a Notice to Terminate Tenancy". I have to "serve an answer" by Jan 22 and the court date is Jan 26th. I want to move out, but need some time. What do I write in the answer? Any other advice?

well #1 do you have a lease..????

If not you are a month to month tenant, and the landlord has given you proper notice and you did not leave.

You dont have to serve an answer, JUST appear in court on the 26th and offer to the judge a settlement of you security deposit for the rent, since you have vacated the apartment by then....

So use your vacation, sick and personal days to look for a NEW place to live.

You would be liable for his attorney fees plus rent and damages if you stay.
