I own a condo in Ohio. I have renters that still owe me for last month rent (May 2001) also their lease expired this month (June 1 2001). I have a detainer filed in court - our court date is June 20th. The agreement was they pay all utilities. Upon moving in, the dishwasher was broke, I told them I would pay for a repair man if they needed the washer. The tenant replaced the dishwasher (lease states they cannot alter property or remove fixture without written permission). I agreed to pay their water bill until the washer was paid for. The water bill has to remain in my name. Because their lack of payment I couldn't pay the water bill. Can they come back on me in anyway for that? Is there any way the can win the eviction?

Can't turn off services.....

You need to continue to have water to the unit and so you must paid the water bill. You do not want them to tell the judge that you have "reduced services" in any way at the trial date.

you couldnt pay the water bill.......

THEN SELL THE CONDO........

If you cut off, or allow the waterto be shut off the tenants WILL sue you and WIN!

And probably get some FREE rent out of this ...

Apparently dj1 doesn't read the "be considerate, respectful and polite" blurb before entering their reply. No I couldn't pay the water bill because I'm in a bad financial situation! I rented my house out to get on my feet - moved in with a friend who turned out to be a total ass (are you related?!) Now I'm living in a hotel. AND the property is for sale - but hard to sell with tenants involved. Don't bother giving your advice if you are just going to insult people. Apparently you didn't get the whole idea of this website. Now who's the dumb one.

AGAIN, can't turn off serivce

YOU SHOULD HAVE continue to have water in tenant's name and had them provide you with paid bill and then you reimburse them. Keeping utility in your name is a NO-NO. Wait out the eviction. You don't want to be in court and have them tell the judge you turned off their water....D*U*M*B.

In our city the water bill has to remain in property owners name. Everyone that I know that rents in Stow have the tenants pay the wtaer even though it's in the owners name.
