i needed to inquire about a verbal eviction notice that was given to my 19-year old son. he was called over the phone and given a verbal eviction notice for 7 days....complaints of loud noise...too many people walking up and down stairs. he lives in a 3 story building that is occuppied by many other people. i have recently found out that my son and his roommate are the youngest people in this complex and was mistakenly allowed to rent. their requirements are 21 years and over. i was with him and his roommate when they applied for the complex. is a verbal eviction legal......i helped my son financially get into this complex. we live in sw florida and at this time of the year finding him another place to rent would be almost impossible. this is our season. please respond...he was given notice thursday 1/18

does your son have a lease? then he cant be evicted without proof and lots of it.

The landlord has not given the notice in writing stating the charges.

Remeber this is still America and your son has a right to defend himself in a court of law, and have a judge decide.

And he can call you as a witness, and you still are entitled to your security back.

my son and roommate have a year lease.

i guess there is no need for them to start packing their things until they receive written eviction. rent is paid up until first of month. if no written eviction they should proceed to pay next month rent correct?

Yes pay the next months rent.the landlord will refuse it, then he will have to take them to court and prove to a judge that they have violated the lease......

unless he pays off the other tenants to lie for him in court...how can he win? no police reports, no reports from the neighbors,nothing documented no certified letters from the landlord or the offended tenant...etc.

Ok ask your self what loud noise? and who is complaining? have they approached your son and asked to see if they can fix the problem? maybe rugs on a hardwood floor?

walking up stairs huh? unless he has 10 people everynight going up and down the stairs at 3 AM.... then is nobodys business anyway.

No the landlord is an assssssss and this will be a great learning experience for everybody.

A lease is a lease and BOTH sides have to honor it!
