Dear djdj,
My common law spouse is trying to make me leave our home, my name is on the lease but the last names are different. We've been living here for almost a year. Can he call the police to evict me? I stay at home with our children and he is the main provider, does this give him the upperhand?

Yes he can make you leave if he serves you with evcition papers, then you will have a court date and can explain everything to a judge, and if the judge agrees with him the judge will issue an order for you to vacate..

Thas the way our legal system works in America....not bad eh?

But chances are since you are a renter and when the lanlord finds out about this, the landlord will never renew the lease anyway...so all that trouble to evict you... for what?
