i live in brooklyn,N.Y. andhave a problem i have been living in an apartment for close to 3years i had a lease forthe first year but he never renewed it and now he has threatened to get the marshal to throw me out .I thought i had to go to court and see ajudge before iam thrown out . He has been recieving partial payments of the rent and has not sent the payments back hehas tried to get me to use illegal tactics to get help from social services but i'm not going to jail for anything.MY question is do i have aleg to stand on,or do i need to find somewhere for me and my 2year old daughter tolive??

In NYCity a landlord must give you a 30 day notice to move, then start legal evcition proceedings in court....

If the landlord tries to lock you out, throw your stuff out, have him ARRESTED....

Also are you living in an Illegal aprtment? Basement or attic?

If so and there is 3 or more apartments then you can withold the rent since if its illegal the landlord has NO LEGAL RIGHT to collect rent from you...
