My daughter spent 10 years in a relationship with a guy who is refusing to give her joint custody of their 6 y/o son because of her lapse of good judgement which has nothing to do with the child. He is the legal father, he is allowing her some visitation but this is mentally wrecking her as she has never been separated from her son from the day he was born. She signed a paper in his attorney's office and was told there would be a custody hearing within 30 days, that never happened. Also if she mentions joint custody to him, he threatens her with "evidence" and that she doesn't want to go there. Can he do this? Should she get a lawyer? Will the courts overlook her mental lapses if she is using proper medication and in counseling? Thank you

In 6 years she has NEVER been apart from the boy? That's either hyperbole, or a very VERY unhealthy relationship.

Yes, she needs an attorney. Please feel free to have her log on with her own questions if she wants further information.

...and kudos to dad for stepping up and caring for the child while mom has been unable to.

The state involved is necessary. And it would be best for your daughter to create her own account and to post her own questions. She is in the best position to answer relevant questions.
