Even if they said I defaulted on responding to the papers that were served to me? Also, Andrea my girlfriend was on the papers and she didn't show up for it either cause her mom told her she didn't have to? If she signed a waiver of service and an attachment A paper does that mean that she signed over anything? She doesn't know what the attachment A papers were, all it said "was see attachment A" but she was never given that to see. The waiver of service just said that she just waived her right to be served papers. Is that a problem?

P.S. How do I or the mother of the child go about doing that? Do she or I need to get a cop escort to get him out of the house or can she do it herself?

Chris, this situation is a mess. I suggest two things. Take the birth certificate and your ID and the mother ID to the police. Tell them that the GP refuses to hand back the child and has kidnapped him. The police do not like to get involved but if you can both prove you are the mother and father of the child then they should. Insist that they do.

Regardless of the above, retain an attorney and get face to face legal advice. He will be able to search for any papers that have been filed and tell you where you stand legally.

One last thing

Sorry for not keeping all this together now. My girlfriend is 20. So, it doesn't matter that the grandmother has residency or not we can still go get him? Sorry, I just want to make sure I can legaly take him from the grandmothers house today with out getting in trouble.

If you are the father, and your girlfriend in the mother and you have a birth certificate to prove this, then the GP has NO LEGAL STANDING to keep the child. Do not, however, break into her home or get violent. Go to the police and do not leave until someone helps you. The child is yours and the GP is refusing to release the child into your care.
