My ex-boyfriend and I lived together for over 8 years, we have owned a home for the past 3 years. About 5 months ago I left the relationship, he kept the house and I have not asked for anything from the home. We had a 1st and 2nd mortgage against the house, the 2nd mortgage was used to payoff several of his credit cards, approx. $3000 went towards my debt the rest was his ($21,000). He had always made the full mortgage payments throughout the relationship, I helped with the downpayment and utilities.
He is now having the 2nd mortgage bill sent to my new address stating he is no longer paying this bill and is leaving it for me to pay. I have told him I will not pay the bill as that is his home, his debt and he has always made the payment, I also cannot afford to pay this extra bill and will not be able to pay my own bills if this is added to my debt load.
I have told him if he does persue this without going to court he will force me to file bankruptcy. He sees this as I am only doing this to "screw him over" and he will tell the judge this and stop my chances of filing to be protected from the mortgage company. Is this true? I would only file if he did not make the payments....but he is at risk of eventually losing the home if they are not made.
