ex-boyfriend won't pay mortgage

Hi,

I left my boyfriend of 8 years back in July of 2004. We owned a home jointly which when I left we agreed he would keep the home and I said I wanted no profit from it as he has always made the house payments and I helped with the downpayment and other monthly expenses. We also owned a timeshare jointly which again he always made the monthly payments and I helped with the yearly maintence fees. He refuses to refinance the mortgages or sell the timeshare as he wants to pretty much ruin my credit and try to stop me from being able to purchase a new home when I want to. I cannot afford to take him to court to force him to refinance. He is now having the 2nd mortgage statements and the timeshare bills coming to my new address, he feels I should pay these bills now. The timeshare has not been paid in months and they are now threatening sending the account to collections. He has tried to charge these bills to various accounts of mine which I report as fraud. I do have about $10,000 in credit card debt and owe about double what my car is worth...I pay my bills each month and not behind in them.

My question is would my only option to get out of the mortgages and the timeshare is to file bankruptcy? I have always had good credit but not sure if filing bankruptcy would be better then past due collection accounts. Any advice would be greatly appeciated.

One alternative: File a partition (forced sale) lawsuit. The court will auction off the property (both of them), pay the lienholders (mortgages and whatever else), then y'all split what is left, if anything.
