I have transfered my H1B to a new Employer. My ex-employer has not yet sent me the W2 form of 2005 in spite of my requesting him for the same. How long should I wait for my W2 from the ex-employer and What action can I take in case the ex-employer does not send the W2?

The employer had until 1-31 to provide W-2s, and if they placed in the the mail in time to be postmarked on that date they are legal no matter how long it takes for them to be delivered.

The IRS will not accept complaints about W-2s not received until February 15. If, however, you have not received one by then and they refuse to submit a copy to you, you can contact the IRS for assistance.
