What is the name of your state? Illinois
Does anybody know that if he is in a death situation, would she have the "legal" right to make decisions? He has been living with a girlfirend for 3 1/2 years and he does still have both parents alive. He does not have a living will or any will at that.

My response:

She has no right to make any decisions. She's an adult, and unless she has been given SPECIFIC rights under a Power of Attorney, she can do nothing.

Edited to add: I was posting at the same time as IAAL. You probably wont get better advice than you just did.

If your ex has his mental facilities, it would behoove him to do a living will, so that it is clear what he wants done, and who he wants making the decisions.
