Ex husband won't give me my son back. Police say it's a civil matter

I have a daughter with my ex husband and we have court orders and child support orders for my daughter. She isn't the issue . I got pregnant had a son while I was still married and it wasn't my husband's child. During our divorce my husband signed a paper saying he is not the father of my son. The biological father also signed sayin he is the dad. Now my ex husband has my son and won't give him back. My ex is on the birth certificate but I never took him off because the divorce papers acknowledge that he isn't my son's father and had no rights to him.

Go get the birth certificate changed ASAP. You probably also want to move up the line at the police department as its more than a bit weird for your ex to try to keep a child when his paternity has already been disestablished and it appears that he cooperated with that disestablishment. I find it concerning. You need to explain things very thoroughly to the police supervisors.

If that doesn't work then you need to hire an attorney to try to get emergency orders from the court ordering the police to assist in retrieving the child.

I don't blame police for seeking to duck what they see as a civil matter ...you didn't give your state...look up your state law as to interference with custodial parent ...it might apply and that might be a criminal matter , also kidnapping might apply .

Being on the birth certificate adds to confusion but apparently there is a written record of him not being father and somebody else is .

Try higher up in the chain of command at police office or your local district attorney s office

Kinda bluntly: Do you have any personal issues or history that make the police reluctant to help you?

What age are the children?
