Hi,
My husbands ex girlfriend is planning to let her mom take his daughter to Florida for an undisclosed amount of time! We have barely been able to build a relationship with his daughter due to her moving all the time and her phone being disconnected. We basically have been putting up with her for 5years now but are fed up. She has bounced from town to town, had a boyfriend move in and had a child with him (he has since moved out). And 6wks ago she moved again on us not notifying us of her whereabouts, but its been rumored she moved in with a couple of friends. If she lets her mom take her for the summer do we have a case for getting her? I guess she planned to still receive child support even though his daughter would not be living with her. TIA

My response:

Where are your boyfriend's court ordered visitation papers?

Actually he is my husband we been married since 96', dont know if that might help his case too. Anyhow we have his papers and they say that she has 10 days to inform us of her moving. I am just wondering how can she plan on giving her daughter to her mom for X amount of time and dont know when she will be back. Husband just mentioned she actually mentioned her starting school down there. TIA

My response:

Sorry about the misnomer; I meant your "husband."

Anyway, as soon as G-ma has the kid, get into court. You can't do anything until that actually happens because, right now, anything else is speculation. Make sure your husband has actual visitation orders. If he doesn't, then make sure he gets the proper orders for visitation. Without those orders, she can do whatever she wants with the child.
