My husband and I seperated for 1 year, during the seperation, he got involved with a wealthy women. She encouraged him to buy a new truck and put the down payment on it, it was never mentioned as a loan, now since he came home she is claiming she saw a lawyer and she wants his truck. Her name is no where on the truck, she just made the down, he offered to pay her back in payments. She said she wants the truck no problem if she could get his trade back, but that wont happen, can she even sue for the down? I see it as a gift, no promissary note was signed, regardless he still wants to pay it back.

sounds to me like a verbal agreement. that can't be proven in court without a valid witness. did she actually make the down payment or just gave him the money for it? if she made it, she may have a document of it and may be able to sue for it back, depending on the judge. if there is no written document or a valid witness of her giving the money to him for the down payment, she more than likely can't get it back. also, if your husband is making the payments on it now and it's in his name and she's nowhere on any document of the truck other than the down payment (if she is recorded as paying the d.p.) than no she can't get the truck back. or at least she shouldn't be able to.
