IL. I ned help, my husbands ex has sole custody of thier daughter whois four and in preschool. He use to have her every day after school and ever other weekend. However thier divorce papers are so vague about visitation. It states: "...the minor child starting pre-school or other school, whereas it is not required that "his name" have her daily care, that the issure of child support will be reviewed by the court." also that he gets every other weekend, alternate legal holidays, alternate christmas/eve, 1/2 vacation periods at christmas and easter, and for a period durring the summer as agreed by the parties. The reason that we are having problems is that the ex stopped letting the child come over after school and started taking her to the childs grandmothers house. His ex also states that since she has total control and custody of thier daughter that when we are to have her on christmas that she will bring her over at noon, then pick her up at 6:00 pm. This can not be right. His ex has also done things like tell thier daughter that her dad is only her baby sitter because he watches her while mommy is at work. My husband has the opportunity to stay home with our daughter to raise her and dosen't see why he can't do the same for his other daughter. Is it possible to get an immediate hearing for custody or something even if it hasen't been 2 years since the last hearing? We really need help his ex has done a lot of really mean things and has used thier daughter as a pawn it all of it. Also we can not afford an attorney can you tell us ways of getting a public deffender and if it would be wise to go that route? Thank you very much.

You can not get a public defender for family matters. Custody is out of the question with the little you have told us. Therefore his only option is to petition the courts to iron out the visitation and try and put a detailed schedule in place. Without an atotrney, I suggest you find a paralegal in your area who will help you with the forms and filing.
