What is the name of your state (only U.S. law)? Texas
My boyfriend was living with a friend, both signed the lease for an apartment. The friend moved out a couple of months ago so he could live with his girlfriend but kept his name on the current lease.
He has since started causing problems saying since he's still on the lease he can come over and take anything he wants. This isn't my issue, but it's relevant to the question. We called the apartment office and requested he be removed from the lease and found he must come in to remove himself.
After some thinking, my boyfriend and I started to wonder if my boyfriend could just take his OWN name off this lease and move elsewhere, thus leaving all financial responsibility to his old roommate. Yea it sounds shady but really, the guy should have taken his name off the lease once he moved out.
The main question is, could he sue my boyfriend for the rest of the rent owed if my boyfriend removed himself from the lease?
