I own property in New York. I allowed Mother in Law to move onto a part of the land. She put in a trailer, well and septic. She was told she could stay there as long as she wished. She no longer wishes to stay and has left the property without notice. I got her fowarding address from the Post Office. Since she has left, I want to send her a letter asking what her plans are for the trailer, ( A demand letter). The well and septic are immovable and we feel that the cost has been absorbed by the 3.5 years she has lived there. Needless to say, we have severed ties with her for many reasons. There was never a written agreement, (against my judgement) . We are afraid she will be back or worse, her think she can rent it out to someone. The power has been turned off and she just put the cats in the yard with what was left of the food. Is there a legal issue here or just tell her to remove the trailer? Things like this always come back to bite us, so any help is appreciated. Thanks.

Because the cats need love and attention and are FAR more valuable then your mother in law!


You have to file for eviction in court,of her and the trailer, she abandoned the property, and she has no rights to rent it out, Go to court on the court date, and when she doesnt show up...YOU WIN......then take the eviction papers,and have a sheriff or marshall put a lock on the trailer.

Don't worry about 'happyroach', he obviously doesn't understand your situation.

There is NO lease in place. Send your 'M-I-L' a certified letter (RRR) to her last known address. In it, demand that she contact you within a reasonable time (30 days from receipt?) to arrange for removal of ALL of her property and to return YOUR property to its original condition. Include that in the event that she doesn't contact you as required, the property will incur 'storage and handling' fees in the amount of $X.XX per day and that she will be responsible for ALL subsequent costs of removal, storage and costs of repair of the property to its original condition. Further state that if abandoned for an additional 30 days beyond the required notice (60 days from receipt), the property will be considered abandoned and disposed of at auction or public sale and any proceeds over and above the costs and fees incurred will be sent to her. (You can't just keep any proceeds.... she has a right to her property or value over and above costs.)

Document EVERYTHING (including inventory) and keep copies of ALL documents!!

Thank you for the info. It is about what I figured would need to be done. Is there a limit to the amount for " Storage and handling? Not that I want it. I just want her to take it seriously and act in a timley manner. BTW, her verbal agreement was to take care of our tax bills every year to allow her to move up here ( which she never did ). We were ok with that until she started selling our antique belongings because she needed the money.:o

Make it $50.00 per day!! As long as you have given the information to her and let her decide if she wants to incur the charges, you should be okay.

Basically, what you are doing is trying to protect yourself against any future claims that she might try to make against you. If you do this properly, you should be able to shut down any claims that she might try.
