What is the name of your state (only U.S. law)? NJ
My ex-husband frequently appears disoriented and stumbles and sleeps alot. He has shared custody so he has physical custody for days at a time. He explains his behavior as due to being on klonopin a psychiatric drug for depression. I do not want my 10 year old daughter being in the car when he drives or spending overnights with him. She expresses it as she is babysitting him. I would like revise our custody agreement so she is not in danger. I believe it is only a matter of time before he has a serious accident and she could be hurt as well. ow should I pursue this legally?

Because you are not a doctor, you won't be able to argue efficiently on whether he is disoriented or not. If you don't want him driving, then you may end up providing all the transportation.

maybe talk with dad and tell him that you have noticed a difference in him, he may not notice.

Then maybe he could talk with his doctor and have his dosage changed. Or if it is fairly recent that he has been taking the meds then he may level out and not be drowsy or seem disoriented after his body adjusts.
