My ex girlfriend took my son and left state. The police investagotor was able to track her down. They ask questions like, Why did you feel the need to move out of states? She lied and said because of all the voilence from me and felt she would be harm. If her new partener was around why didn't he due anything. So they ask her to give dates and events that took place and the BIG QUESTION # 1 if these all was to have taken place and she was afriad why didnt she call and make reports or place an order of protection on me. She could nt answer any of there questiojns or supply info to any thing.

She never mention any of this to her family or friends, what she told them was She just wanted to get away from here with her new so call to be husband.

I have no order protection against me, but I had one against her in 2001-2002 plue a police report made when she came to my new home and wife.

What can I due to support my side and what can I do to show that she has no leg to stand on to try and use that in court. She took my son and left state back in dec 2004 she has violate my vistation rigths and I did file custdoy papers for the first time I want my son there is much more but please if some one can direct me to info or next more I'm not able to afford an lawyer, but my wife is pretty help when it comes to filing things or how to say it. You have filed contempt and to change custody, and have a court date where the judge ordered her to return to AZ. Please contact your son's case manager re this, you really should have an attorney to help with this, did you contact the DA re parental kidnapping, are they going to press charges? Lost my directions help

Az, The police were able to track her down, by forward address. She even received the court papers they sent back in Dec on what was going to happen and all. She even got the one that said she needed to be back in Maricopa with her son she not. When she left back in Dec she told all her friends and family that the reason wanted to leave was to just get away from here. Well guess what she told the police, I had threaten her and she was afraid for her life. When the police ask for dates and what took place and why didn't she make a report to the police guess what ( she couldnt account for days or events or even give a reason why to anything, just didnt have answers. With my new wife of 5 years there has not been any DV in our life or with my ex. Now on my ex I have one police report and order protection I had to place against her in 2001 or 2002, where she came out to mu house. The investagor told her she had to have a phone number for me to call my son. Well I did last week it was the saddest day of my life. My son has a Communcation Disorder(not able to expresss himself and process things keep this in mind. My son Kevin got on and said to me, your not my daddy anymore Dwyane is and that I'm hurting his mommy.I haven't seen my son since 11/14/04 and last time talk to him was on 12/14 both times everything was ok. Look what she is doing to him. This last 5 years seem like nothing took place no relationship built between all of us. My court date is coming up the 28th the 25 is medeation she wouldnt be here. She thinks she did nt do anythign wrong by leaving, she thinks that GA is the legal state to be handling this, not we file first in Az and this was Kevin home state till she disappear. I need help with the evidetary hearing coming up, I dont want to over due it, but I want my son back, where he can get the love and proper care to help him with all this and what she has put in his head. The Judge has ordered her to return to your State , due to contempt . That is a good thing .

You can certainly ask for a change in Custody due to her actions .

At the same time request that If the court does not allow a change in Custody , you request considerably more visitation times with your son , including possibly the entire summer vacations.

Also , bring to the court's attention you are concerned your son's needs are not being meant . As a Parent you should be speaking to the school's councilor and other personnel that deal with your son's IEP's and disabilities .

This is from your prior post . The Judge will NOT be pleased that she did not return the child to the State and can impose sanctions for contempt . He can Order her to return the Child Or surrender her self on such and such a date to start serving a Jail sentence of ( what ever amount the Judge decides ).

If she does not the Court can issue a warrant . The Judge could also order a change in Custody .

You would then file a Certified Copy of that court Order ( registration of foreign Custody Order ) in the appropriate court where she is residing . It would then be enforceable in that State . You can do that with the Current Order for the Child's return also , and should .

The Question was asked , HAVE YOU TRIED to file a Criminal Kidnapping report with Law Enforcement or the DA's Office ?

You can also get any child support payments Suspended during the time of the Denial of Visitations . You have to file a Petition and go to Court .

You should settled for No less than the Return of the Child as the Judge order . If she will not return with the Child , demand a Change of Custody .

Settle for NO less .

The Judge will not be pleased with her " Souring " your child against you either , with statements like You aren't my Dad anymore .

Az There was another mintue entry jan 29 05, from the ex. Boy did she fail.No action will be taken, court got letter from her it states the court cannot consider for the following reasons. no indication on the letter that a copys beens mail to me as require to ARS of Civil Procedures and that the court canot consider an ex part communcation of this nature nor give legal advise. Goes on to say there is no evidence that a original documnet has been file with the court and the document does not contain a poper caption setting forth the name of the court title of action file number and proper disignation of a Motion or request for relife as require by ARS It is Order rejecting the letter no action taken. Boy I would like to know what was in the letter. With her own admission to the police and haven sent a letter she has acknowledge receive all mail that was sent out and forward to her. Knowing this, she still did nt comply with court order in returning her and my son by Jan 14, she also admitted cannot afford to fly back and attend the hearing. How do I go into court making sure charges and arrest warrent is issue and get what I'm asking for my son? How due I now turn this into Criminal Kiddnapping, the office has made contact with the ex. What do I need to due or now call? He did call his mom and she got mad at us saying why did we put him up to it against her wishes. Get this at any time she could revoke the letter. The week they were here my wife took them along to her denst appt with her kids, Kevin got seen. He nneds special mouth piece, I ask the denst could this have been prevent if seen every six months with regual denist, yes it could have. You mention have I file Criminal Kidnapping report with the law, I file access interference as it relates to my visitations I have.

You keep mentioning Police .
Is there a Criminal Interference Report being pursued .

there is a difference between Criminal & Civil . It is Important to know If Both are Being Pursued .

The Court has rejected the xparte letter , and in letter pretty much has indicated she did not give you proper notice ( as the court has no proof of it , and she was aware of the orders ) That is CIVIL Contempt .

You have filed . A court date could be set , and a Judge would make there ruling .
The proof you need to show is , The Original order . Proof she illegally relocated with the children . Your attempts to demand your visitation , etc . Proof of her attempts to alienate you from your children .

For your information if all that you cab go by is CIVIL contempt . The Judge could order her to return the child OR surrender herself to Jail for a ( Set period of time ) , or an arrest warrant issued .

Having said that , the other State would most likely will not enforce this .
If she came back to the State then the Police could pick her up .

IF the authorities are pursuing Criminal Charges that is different .
