I know I am not even posting in the correct forum...but I don't know where to post this and since it deals with my ex I am hoping you guys can tell me where to post it or have advice.
So I just got my credit report only to find that my landlord from 4 years ago sued me for $2771.00. I was never notified. Here's the story on that...
In Oct. 2004 my daughters dad had me and my daughter move out of our house that we were renting. When I had tried to go back to the house to get my things the landlord (who was also the neighbor) came over and said I can not go into the house. He took my key. He said I was taken off the lease. I was also told by my ex that he took me off the lease. I never got it in writing (as I have learned now in all my paralegal classes thats a big No No!) I was never even notified that my ex had owed money or was evicted. I figured he got evicted because he was in jail for months with all his meth charges. He lived in that house for about 2.5 years after I "was taken off the lease." So now years later, I have this on my credit report. I don't even know how to contact the landlord...he passed away, so his daughters name shows on the credit report but no phone number. I don't even know where to start...the court house maybe??? Should I email my ex and ask if he knew anything about this? I am so upset...because now I have to deal with this on top of all my other custody issues. Sorry if this is the wrong forum...

I sure hope you're in your first month or so of paralegal training.

Go to the courthouse, pull the file and see if there is an attorney of record. Contact the attorney.

You were sued and you lost. Now you have a judgment against you.

You need to get a lawyer and learn about the process of getting this judgment vacated since you were never served.

Your ex, the landlord and the courthouse will be of no use to you in getting this resolved. Your ex cant help you. The landlord wants their money and the court cannot give you legal advice or help you file the necessary paperwork.

And an attorney is going to cost significantly more than what you supposedly owe.

Dispute the item on your credit report stating that you had no valid lease w/ the person listed as the debtor. They'll either have to produce proof that you DO owe them, or drop the item from your report.

You'll still have the judgment against you, but you can figure out how to file to vacate that pro se.

yes actually i have only done an interviewing and investigating class, and had one day of my legal ethics class...thats why i have such little knowledge! lol. but i have to start somewhere right :rolleyes:

How old is this judgment?

Thanks haha. It says on my credit report 2007. I am pretty sure he moved out at the end of 2006.
Quite honestly, there is not much you are going to be able to do about a 2 year old judgment. In fact, you've got about 180 days to do a motion to vacate on the grounds of no service.

So... make arrangements to pay the judgment and if it's worth anything to you, sue the boyfriend. Was this a small claims case?

It said Civil Claim Judgment. What a nice april fools day huh...wish it was a joke!
