Ex wife abandoned kids? How do I get custody order changed quickly?

California Resident: After a bitter divorce preceeding lasting almost 2 yrs where ex went through 3 attorneys, a court order awarding 50/50 custody of our 2 kids (5 & 7) followed by a very unhappy ex who thought she would take everything.

After family home sells, she moves in with boyfriend more than 30 minutes from kids school. Custody evaluation calls this scenario "B", where kids stay with dad during school week, and mom 3 weekends a month. Mom calls me tonite stating she has moved an hour away, and she guesses we now go to plan "B", when do I want to start?

I'm absolutely convinced that I can provide a more stable lifestyle for my kids, as mom is emotional wreck, selfish, unstable. (plus I'm a great dad!) Incredible she would give up kids this way.

How do I get court order to modify custody and support in a rushed fashion?

How do I get it to stick so that kids stay with me full time indefinitely?

Any other advice...things to watch out for?


I've always been an advocate of kids needing both mom and dad (50/50 custody). However, she's gone too far here, and I'm now responsible for their stability and development.


Please offer advice & suggestions!

I really don't know much about custody but..you would probably have to show a good reason to the judge why you think the orders need to be modified. Unless the child is in danger I doubt you can get a rush job. Is child support being handled through CSE. You could ask for a modification through them if so. However there has to be a substantial change in your situation for that such as..increase or decrease in the amount of her income, day care, medical expenses, education like a special school and other extrodaniry expenses like that. Also the case may have to be 1 to 3 years old depending on the state you live in. If it's not going through CSE you'll have to go to an attorney or go to the clerk of courts office and ask for the papers and file them yourself..also for the custody. You will probably have to pay a filing fee and probably court costs. That's about all I know.
