What is the name of your state? Florida
My wife and I separated in 2004. My house was worth about $100,000. We finalized the divorce in December of 2005. Today, June 2006, the house is worth $250,000. If my ex wife sells the house my half will still only $50,000. That's OK.
In December my ex wife refinanced. She paid off the $65,000 loan and took a $105,000 loan in order to add a bedroom for my kids. I stayed on the deed, but am not responsible for the loan. Today I found out she is about to default on the loan and the mortgage company is about to foreclose on the property. She has made three out of six payments.
My question is what are my legal options? Can I move back in and take over the house with the kids and refinance as soon as possible. Should I offer to pay her off for her half of the equity minus the $40,000 for the home improvement?
Do I have to go back to court?
I'm going to get a lawyer.
