ex-wife no job - CS possible?

What is the name of your state? Maryland

My ex has no job ( that I'm aware of ) and is living quite well with her boyfriend. I have sole custody of my kids. My lawyer file for child support last week - the hearing has not been scheduled yet. My question is what should I expect the judge to do at the hearing? Can he force her to get some kind of job? She is physically able to work. She wants to see the kids on visitations, but, doesn't show any interest in supporting them.

Have your attorney ask that CS be based on imputed income. An income based upon what she is capable of earning can be used. If she has no job skills, they can use minimum wage. She is, after all, voluntarily unemployed.

You can't force her to work, but she can face the consequences of failing to support her kids if she chooses to not pay any CO'd support.
