I posted about this similar topic about 3 weeks ago...now that I know more, I have a few more questions. Dissolution was final last week.
ex-Wife coming to get her stuff next week from my house, which I was awarded in the agreement....but there are questions about what she will take...she believes she (or wants) gets a lot of the household items, dishes, linens, towels, pictures, etc...

I believe she is not entitled this because the sep agreement declares the following:

Each party shall retain free and clear of any claim of the other party, all household goods, furnishing, clothing, jewelry and personal effects in his or her possession as of the time of execution hereor, except as otherwise detailed herein.
Husband shall have as his property free and clear, etc, etc. etc...
Wife shall have as her propertly free and clear of all claims of husband, the cherry bedroom furniture, all tiffany lamps, eureka vacuum cleaner, all holiday and seasonal decorations and the patio furniture. Wife shall remove her items from the residence within 30 days of the date of the final hearing herein.

So with this definition, I believe that anything not SPECIFICALLY defined in the agreement, such as the pictures, dishes, linens, etc, would remain with me since they were in my house when we signed the agreement. Especially since these items were factored into the negotiations. However, I suspect (I know as she has told me) that she will want to have this stuff when she removes her items. In much the same way, she came over in August and took a lot of things that werent clearly hers, but i left it go and now she has full right to those items becasue there were in her possesion on the date of the agreement, correct? We are probably only talking about $2000 here, but it does matter.
(ALso, what about jewelry that I bought for her during the marriage, that she has still left at my house? I plan to let her have it, but wonder if this is required?)

I already recieved GREAT advice to have all her items placed into the garage and ready for her to get them the day of the removal. I plan for her to NOT enter the house that day to prevent other problems from happening.

Can you shed some light on this and let me have your comments...
What if she forces her way into the house? I plan to have the door locked and will call the cops if I have to.

Thanks in advance!

If she forces her way into the house that can be prosecuted as breaking and entering, criminal trespass or other crimes. Her personal belongings should be hers. Anything not otherwise spelled out is yours if it is in your house.

Print out the list and bring the stuff out to her, instead of her coming in. Have her cross each off the list as she receives it. Or, if you have a garage, place all the pick up items on the garage, neatly and carefully. That will keep her from cruising through the house. If she still has personal property there, get that to her as well.
