Q: Dosn't the court have to be violating your probation in order to impose new terms on it?
A: No. If you violate your probation and the court continues you on probation (instead of throwing you in the clink), then new and additional conditions may be added to your probation. You do not get rewarded for violating your probation; you get punished for violating your probation.
Q: Without the violation isn't it a double jeopordy issue?
A: There is no double jeopardy issue since you are not being tried for the same crime again. You have already been found guilty of it.
