What is the name of your state? MN

Does anyone know how to go about changing a visitation order to dictate that NCP's spouse cannot be present during visitation? Is there a legal term for that? Would that only happen if we can prove abuse?

NCP is being agreeable at the moment about excluding spouse from future visitation due to a recent incident -- CP would like to act quickly to make this legal, so any advice on how to do so is appreciated. Thanks.

~ First of all why are you trying to exclude the NCP's spouse?

Two issues here:

One, it's unreasonable to exclude a spouse from being in their own home while the parent has visitation with the child. The parent is remarried and their spouse is part of their family unit.

Two, "if you can prove abuse". If you can prove abuse, it will depend on what kind of abuse (ie; is it your version of abuse or is it the legal definition of abuse)- who did the abuse- were Children's Services notified? Did the parent rectify the situation &/or were they even aware of it? Is the child in continuing danger?

If the child has been abused, you need to report it to the authorities. Possibly get counseling for the child, which normally includes both parents to find a solution to whatever the problems are.

You haven't given near enough information to even get an idea of what exactly you are talking about.

Was there an issue of domestic violence where the child/ren were present? If so, Notify Child Protection ASAP. AT any time the NCP can change their mind and have the Step parent return to the home during visitation.
Were the child/ren abused directly?
Why do you want the step parent excluded?

If the NCP is agreeable to excluding the spouse from visitation, then you would draw up an agreement to that effect and submit it to the judge for approval/signature.
