What is the name of your state? California.

I have questions regarding Exempt vs. Non-Exempt status.

1) How does one know what constitutes exempt vs. non-exempt?

2) Another employee and I had the same job duties, however, he was paid overtime and he was not docked for time he took off. I was not paid overtime, I was also not docked for time I took off. Is this legal? I wondered because he is, obviously, a male and I am female?

1.) One reads the information at www.dol.gov under Overtime Exemptions.

2.) Without knowing if you are exempt or non-exempt, there is no way for us to know if you should have received overtime or not; nor is there any possible way for us to know what your employer's motiviation was without considerably more information.
