Expedia.com owes me refund of $1,274.82 - can I also sue for punitive damages?

In April of 2005 I purchased an airline ticket to Dubai, UAE through Expedia.com for the amount of $1,274.82. The next day I had to cancel the trip and called Expedia.com to cancel the ticket. Expedia.com agreed and informed me to send the ticket back to their office in GA via FED-EX for a full-refund..

The ticket was returned and I was informed that my refund would be issued within 3 billing cycles...that was in April 2005 -- 7 billing cycles ago -- and still no refund.

After speaking to Expedia.com representatives on the phone numerous times they have said my refund was being "processed."

I filed a complaint with the Better Business Bureau against Expedia.com and the airline (Emirates) and Expedia.com has not replied. Emirates filed a statement indicating that Expedia.com charged my card and must issue the refund.

I complained to my bank (WAMU) through whom I purchased the ticket (check card) and they issued a provisional credit, but have now charged back the amount to my bank check card.

I would like to sue Expedia.com for this amount ($1,274.82) and also seek punitive damages for their failure to issue my refund under a legal theory of "Breach of Contract."

My questions:

1) Is "breach of Contract" the correct legal category for this dispute?

2) Thus, what kind of lawyer should I contact?

3) Can I seek punitive damages against Expedia.com in this case? (If not, I'll just file in small claims court.)

Do you have anything in writing from Expedia with respect to a refund? And no, you are not entitled to punitive damages.
