Our business lease expired 2/28/05. After that, we continued to occupy the space on a month-to-month basis as provided for in the expired lease while we were working out a new lease with the new landlord. Initially the new landlord gave us a draft copy of a new lease indicating that the rent would increase by about $200 per month (and we paid this increased amount for March, April and May). In May he finally submitted a lease for us to sign and the actual rent amount was an additional $500 - on top of the $200 increase earlier. We didn't sign the lease until July. During the month-to-month time, we paid the increases he asked for - to keep him happy and off our backs. It seems to me we would have been within our rights to continue to pay the OLD rent amount until the lease was signed.
My question is this: did we overpay him for March, April and May ($200 per month) and June ($700) because we didn't have a lease with him until July 2005? We signed nothing before the lease was signed in July - not even a letter of intent. Is it foolish to expect a rebate or a reduction in rent for a month to recoup the overpaid money? Or are we better off just letting it go?
