Expulsion due to possession of marijuana

My high schooler was arrested in school with 1/2 ounce of marijuana. Since most of it was packaged (nickel bags) , they are claiming intent to sale. There is no other evidence indicating this and we know now that it was for his personal use and it was purchased that way. He was released with a notice to appear shortly after his arrest and this is his first offense. He was suspended from school and we were asked to return next week to "be advised of his rights and possible expulsion". Based on the Parents booklet of rights, the principal can make a decision not to pursue expulsion , if this is the first offense and less then 1 ounce . My question is, since the police has cited him for intent, do we have a case to make with the principal to give him another chance. My concern of course is that the principal may believe the polices opinion that there was intent. Thank you for your advise.

**A: is this a private school or public? Is your child a special needs student? What is your child's grade and GPA and has he/she ever been in trouble with the school before or with a previous school? does your child have a record at the juvenile section of the local police?
If he had that many bags in possession, how much does he smoke if the bags were only for personal use? Doe she have a medical certificate allowing use of the stuff?

This is a public school in California. He has been in trouble in a previous and his home school however the administrators were terrible and had a hand in some of it, i.e. zero tolorance. We had him transferred to this school. He has been doing well from a behavior standpoint until this. He is a fair student. Struggling with two classes and B & C's for the others. He says that he just purchased that much because of the holiday break (2 weeks) and didn't want to take a chance and buy some during break. The person he bought it from only had it packaged that way.

He does not have a medical certificate. He says he has been using because it makes him feel calm and focus because of pressure with the higher academic at this school. We have seen and will continue to see a drug counselor and having his doctor see him to determine if depression is involved. Depression runs in our family. Both his dad and grand dad are (were) on medication. Thank you. I appreciate any advise you can give me.
