What is the name of your state (only U.S. law)? NY
If a federal inmate awaiting sentencing has been incacerated because the prosecution insisted he was a flight risk (he could barely walk and kept passing out even at the courthouse), has been told that all of his arteries are 90% blocked and needs 4 surgeries asap -could he request that he get to go home until sentencing in mid January 2009? Does he have to use his public defender (who has done nothing to defend him for the most part) or can he send the Court in Rochester his request via mail or fax?

Is there any chance that the judge at sentencing could just send him homw and give him house arrest so he can live out his days there instead of spending more taxpayer money? What is the name of your state (only U.S. law)?
