Faciltated Supervised visits never started.. what next?

What is the name of your state (only U.S. law)? DE

Another question..

My ex was ordered faciltated supervised vistation back in the summer on an emergency order because of an incidence of abuse he committed to our daughter. He has yet to set this up..

At what point would this expire?? What happens next because of him never starting this?

We still have the final hearing on vistation coming, dont know when but it will be sometime next year. I think he is waiting until that hearing and see what the judge says.

My current husband would like to adopt my daughter. When, if ever, could we petition the court for him to do this because of a lack of visitation from the father? I am thinking years not months but I still would like an answer :)

You need to be sure to bring it to the judge's attention that dad chose not set up the supervised visitation and chose not to see the child at all. You don't have to do this until the next hearing. Until a judge orders differently, the supervised visitation stands.

As far as your current husband adopting your children, that won't happen unless dad would be willing to give up his parental rights voluntarily, or until/unless a judge is willing to terminate dad's parental rights involuntarily.

Your assessment of years, rather than months, is the far more likely scenario.

They are two seperate issues: child support and visitation- so have been posted accordingly. Also the child support question was answered by the time I decided to post this question. Thank you.

I am very interested to see what happens at the next hearing************** He abused his daughter- denied it, fought against the change in visitation during the emergency hearing, played the wonderful dad card during the hearing, and was even offered public visitation in exchange for a psychological evaluation, but declined it because he never thought in a million years the commissioner would order supervised facilitated visitation. So after his fighting so hard against it, he has chosen to not set up these visits at all.

Apparently he only wants to see her on his terms, or not at all. What possibly will the judge say about this?? I know it will not look good for him.

No one can predict for certain what will happen, but what I can pretty much guarantee is that the judge will not be at all pleased with dad.
