I am a party to a licensing agreement executed in WA state that required me to make quarterly royalty payments. I did so for the four years and then stopped payments. Four years after stopping payments the attorney for the other person called about my failure to pay. I said I was unable to pay, but even if I could, I refused to pay and cited reasons. No demand for payment was made until either 2 or 4 years later (depending on interpretation). Is there a statute of limitations applicable here, such that if the party was aware they weren't being paid and made no demand for payment for 5 (or 7) years, they lose the right to sue for non-performance?
