Failure to protect while at school.

My son is 15 years old and he got into a verbal altercation with another student whom is 18 years old. After the altercation dispersed and they were going their separate ways then the 18 year old sucker punched my son. He caused my son to visit the ER where they treated him with a CT scan, he had a concussion, five stiches, and several fracture to his nose. The boy was sent home and my son was sent the emergency room. When I got to the hospital I asked to have an officer meet me there to press charges. The officer took my sons statement and pictures then went to "arrest" the 18 year old. About an hour later the officer came back to the hospital to inform me that the boy was 100 pounds soaking wet, and my son could have taken him easily. He continued to tell me if he were to put his cuffs on him they would slip off, that is how small this boy is. I then asked the officer does that mean he is not getting arrested. The officer informed me there would be an investigation. I asked the officer did my son hit the boy back and he told me no, the boy did not have a scratch on him.

The next day the same officer came to the house to talk to my son again, however, he was sleeping. I asked the officer what was going to happen and he told me he was not sure that my son instigated the fight. I told him they were both having word with each other, and my son did not touch that boy. I called the school and asked if my son was suspended and they told me they were not sure, that they are still investigating the issue and that if he is suspended the days he has missed will count toward his suspension.

I fail to see where the nebulous phrase "failure to protect" even applies here. It appears that the police and the school are still investigating and that there seems to be some thought that your son wasn't an innocent victim in this. This does not mean that the other kid will NOT be punished, only that it may take a little longer to start that ball rolling.
