Got a NJ 39:4-144 for failure to stop at a stop sign at an entrance of a private road. I usually stop before the sign (within 2 to 3 feet) because there is no single white stop line painted on the road to guide me where to stop exactly. At this stop point (before or even at the sign) it is impossible to see oncoming traffic (35 MPH Limit) to your left because of a hill obstructing the view. It requires you to creep 10 feet beyond the sign to see past the hill. I stop anyway at the sign to be compliant and then proceed forward to make a right turn while looking to my left for oncoming traffic. I suspect the police car was the oncoming traffic on my left, and saw me in my forward motion. I can't figure how he could of saw me at the stop sign because he also has that same view obstruction, the hill.

Do I have a defense here to contest in court?

A: Let me suggest that you try to plea bargain with the prosecutor to get a non-moving violation. It may be more expensive, but you won't get any points.

I would argue this thoroughly, if what you say is true.

Which makes me wonder, if you admitted to stopping, yet you ask if you have a case.....

Did you explain this to the officer? What did he say ?

I would not pay a citation when I am innocent, you have a valid case. Make this incident well documented in front of the Judge ( Pictures, different angels) .

The problem the OP will run into taking your advice is that the OP will be deemed biased (as most people tend to be), while the testimony of the expert witness (the officer) will be deemed as unbiased.

Did you get out of it using your photo evidence?
