If a person signs a lien and signs the lawsuit. Can that person be considered a debt collector under the fair debt collections practices act even if they are represented by an attorney.

I questioned a charge on my account with the management company for my homeowners' association. The management company did not respond even though they are responsible for collecting these charges. I then received a lien on my property with a letter from an attorney, however, the property manager had filed the lien, not the attorney. Therefore, when I sent certified letter disputing the charge again, I sent it to the property manager. My thoughts are that he should at least be required to forward said letter to the attorney if not reply.

The only way the Fair Debt Collection Practices Act might apply is if the attorney is in debt collection on a regular basis.

I don't know the area of practice for the attorney, however when he sent me copy of the lien he sent a paper explaining my rights under the fair debt collections act.
