I recently found out that someone wrote a series of fake checks against a bank account that I have. It happens that the accounts in question are savings accounts and that no legitimate checks have ever been issued for them. Yes, it is absurd that the bank processed checks for 1) savings accounts and 2) accounts for which no checks have ever been issued. Yes, I am aware that it was probably an inside job. Yes, I have closed the accounts.

The checks were written to a convenience store in Pennsylvania called "sheetz". When I challenged the transactions, some company called "XpressCheX" started trying to pass additional checks for varying amounts of money against the same account. According to google, "XpressCheX" is a collection agency.

I'm concerned about 2 possibilities:

1) Being reported to the police in PA for passing bad checks.
2) A negative item on my credit report from a collections agency.

Since these were completely fake checks, I don't know whether they had my name on them or not. I've asked the bank for copies of the front/back of the checks written to "sheetz" but was told that they were purely electronic checks and that there is no paper backup. There is paper for "XpressCheX", but it does not show a debtor name.

1) I would like to find out whether the name used on the checks was my own. If they made up some other name, its less likely to be a problem for me
2) I would like to know if there is any way for either "sheetz" or "XpressCheX" to "pull" my name from knowledge of my account number.

If either is the case, I'd like to squash the possibility of either of the concerns mentioned earlier taking place. Of course, I'd prefer not to give "sheetz" or "XpressCheX" any more information about me than they already have as I have no confidence in their intent or ability to handle a matter like this honestly.

Do you have a money market or a savings account? They bare similarities in that both accounts earn interest yet they are very different.

Secondly, did you file a fraud claim with your bank and did you file a police report?

First thing you need to do is to contact the bank (??) in WRITING and politely DEMAND that they do the following:
1) Provide itemized accounting of ALL transactions "that they allowed" in your account.
2) That they return ALL funds 'in question' immediately as they have a 'fiduciary responsibility' to those funds.
3) Immediately cease any further withdrawals from the specific accounts unless confirmed by you in writing.

The BANK (??) has liability for their allowing access to your funds that are in their 'care and custody'.

fiduciary
1) n. from the Latin fiducia, meaning "trust," a person (or a business like a bank or stock brokerage) who has the power and obligation to act for another (often called the beneficiary) under circumstances which require total trust, good faith and honesty. The most common is a trustee of a trust, but fiduciaries can include business advisers, attorneys, guardians, administrators of estates, real estate agents, bankers, stockbrokers, title companies or anyone who undertakes to assist someone who places complete confidence and trust in that person or company. Characteristically, the fiduciary has greater knowledge and expertise about the matters being handled. A fiduciary is held to a standard of conduct and trust above that of a stranger or of a casual business person. He/she/it must avoid "self-dealing" or "conflicts of interests" in which the potential benefit to the fiduciary is in conflict with what is best for the person who trusts him/her/it.

fiduciary relationship
n. where one person places complete confidence in another in regard to a particular transaction or one's general affairs or business. The relationship is not necessarily formally or legally established as in a declaration of trust, but can be one of moral or personal responsibility, due to the superior knowledge and training of the fiduciary as compared to the one whose affairs the fiduciary is handling.

I've already done this, as well as closing the accounts. My concern is about whether my name was used on those fake checks and how to avoid further problems.

And there is NO way for any of us to answer that for you.... since we can't SEE the checks.

and how to avoid further problems.
Depends on EXACTLY what 'problems' you are trying to avoid. Some problems are simply unavoidable.
