They called the manager up and he stated that he knew it was broke and never got aroung to fix it. I had alot of knee pain and my knee cap kept popping over to the side. The Doctor preformed a lateral release on my left knee 3 days ago and told me that it was so bad that I will have to have it done again down the road. The Insurance Company has been good so far. They have paid all of the bills and been paying my lost wages. But they want me to settle out of court and I don't even know what to do from here. My response:
You may have a good personal injury (premises liability) claim. The only difficulty would be getting over the "Notice" requirement; that is, did the store know of the problem, or was the problem there for more than a reasonable period of time? If so, then you may be able to collect a settlement or judgment. But, the only way to find out is for you to make an appointment with a nearby personal injury attorney, and get a free consultation.
Good luck
