Hello I am having a problem in a small town in OHIO.
My fiancee came home intoxicated with our 3 month old daughter. We had an argument about her endangering our daughter. I went to call her mother to have her help me with the situation and she attacked me while using the phone. She tried to head butt me and caught the bridge of her nose on the rim of my hat leaving a small mark. Since she disconnected me from her mother who I was talking to on the phone I decided to leave with our daughter to her mothers until she cooled off. While I was at her mothers she went to the sheriff's dept. under the influence big time and said she wanted her daughter back and that the mark came from me kicking her in the face, which is a total lie. Never the less I was arrested for Domestic Violence because of this statement she made because she was desperate to get her daughter back, which she would have if she only waited for me to come back home. Since then she has told the prosecuters the truth and is willing to go to court on my behalf to clear things up and to take any punishment she may have to take for the false accusations.
The problem is we have been apart now for almost 6 weeks with no end in sight. We were first told that the no contact order would be dropped at the pre-trial and I would be able to come home with my daughter and her. This has not happened and we have been talking due to my lawyer said I could talk to her as long as I did not initiate the contact and that I do not threaten her in any way. I told him that I would never threaten her other than to leave her if she does not get help for her alcohol abuse. We are wondering why this issue is taking so long to end when they know my fiancee is not willing to prosecute me for something I did
not do. Can anyone tell us why the system is taking so long to move forward and end these false allegations?. Is it all about the money I will be paying my lawyer to prove my innocence?, I am not willing to sue anyone for taking a false statement from my highly intoxicated fiancee unless they push this to a point I can no longer affored my attorney. Post me if you know what we are in for, THANKS
