False Accusations

I currently work at a "corporation" that is more like a family owned business. The owner of the company sits just down the hall and it seems they bend the rules on how their employees should be treated.

In July I was given a "write up" that the owner of the company's executive assistant forced my manager to give me. In the write up my manager even stated that she did not think I had done anything wrong. I went to the owner of the company and plead out my side of the story and he removed the write up from my file. Since then the "assistant" had barely said 2 words to me.

Recently, I was written up again but this time for "allegedly" having an inappropriate relationship with a male manager. This is completely false! On my write up they stated that I had been "spending excessive time with him and it was making other employees uncomfortable". I disputed this with the HR manager (By the way no one else was in the room and my manager did not even know I was being written up) and have talked to the owner of the company again. Since I have found out that they actually wrote up the manager as well for "sexual harassment" in regards to me. Not only did they also accuse him of this but insinuated to him that I had said it and set him up. All of this is completely FALSE! They claim that they have witnesses that saw us hugging outside the building. We were not! This manager recognizes my exceptional work on a regular basis and I think that is what caused all this. The "assistant" strongly dislikes me now and I heard that when you make her mad either you get fired or she makes you so miserable you leave.

I guess my questions are: Is this harassment towards me? Don't they have an obligation to investigate these allegations prior to writing me up? What rights do I have to fight it? Can I demand they provide me with the date and time that I was supposedly seen doing this? If I know what day and around what time, I'm pretty sure the 200 emails I send out a day could cover a pretty good time frame to verify I was at my desk and not downstairs.

I am a happily married woman! I do not carry myself in such a manner to make people think that I would do such a thing. I am offended that someone would make such wild accusations against me! I need to know what I can do to keep my job, make this go away, and make sure it's NEVER an issue again. Please help!What is the name of your state (only U.S. law)?

Well, I hate to be the bearer of bad news...so here's the good news. You have the option to quit this job and find another one. If you are fired from this company for these reasons, you probably will be able to get approved for unemployment insurance. Because in order to terminate you they must have a clearly defined good misconduct reason to terminate. And it does not sound as though you have given them any proof of your alleged misconduct.

As for how you can stop them from doing this to you, keep your job, and make them stop harrassing you, I don't have an answer. Nothing they have done is illegal or wrong by law. You can't file a grievance with anyone. You have no case with anyone. There are no Texas laws against such behavior by employers as you describe. There is no bureau to enforce fair and decent treatment for employees; as long as they are paying you according to Federal wage statutes, they can pretty much do unjust and mean things to you, as long as you can't prove they were done because of your race, sex, national origin, all those EEOC related issues.
