I just received a Warrant of Debt from the court, referring that i owed some money to a guy who lives on NJ(i live in VA). His Attorney told me that my name and the person who took the money has same name and he looked the address in the phone book(there is only one same name listed). So he send me the warrant. Matter of fact i have never met or known him my entire life. What option do i have? Can I sue him for False Acquisition? Please advice.

Thanks

My response:

Acquisition means to gain possession of something. I think you mean "accusation", which is to accuse someone of something.

Be that as it may, you may have a claim / lawsuit for "Abuse of Process" and / or "Malicious Prosecution".

Make sure all of your ducks are in a row on this, and that you are, in fact, the wrong party. See an attorney about writing a letter to the other attorney, to have the "warrant" dismissed or withdrawn, and to reimburse you for your attorney fees.
