My fiancee lives in Bronx, NY. Her landlord is trying everthing possible to take her apartment because her rent is very low since she lived there for 30 years.
The apartment is still in her husband's name because they are awaiting their divorce. The landlord knows that she is not the tenant of record but has dragged her to court 5 or 6 times. She put in a motion to dismiss based on the fact that she is not the tenant of record. They only served court papers to her but never to her husband who is the only signer on the lease.

The landlord and their attorneys definitely knew that she is not the tenant of record. In July, 00 she had one a small claims judgment against the landlord and they have been harassing her ever since. They even made up a phony lease and submitted it to the court to prolong the proceedings.

What type of lawsuit does she have against the landlord and the attorneys?

Thanking you in advance.
