False profile on Yahoo Personal by someone else

What is the name of your state? Arkansas

I have been defamed on a Yahoo Personal by an Ex-Finance in which my picture was used twice (pictures taken when we were together with her side blanked out). I am humiliated because it is listed in the (men looking for women) but saying in the article that I am looking for a looking for a man (slander). Is there any legal action that can be taken, I am still awaiting an investigation outcome by Yahoo. I have printed the listing off the interenet and faxed the paperwork to Yahoo with my photo id and signed the paper saying I had NO involvement with this profile.

Since this is online I am afraid it will be swept under the rug and written off as harmless humor but my reputation has been damaged and my personal information is on this website for the world to see, which puts me at risk.

It is a personal attack and meant as being revenge stating false information about me.

The facts listed are violated in the contract that is broken when this information was entered online at Yahoo because the person has to accept the terms of the contract when it is posted as saying that THIS is the person for the ad and it was NOT.

My personal information well, my name, where I live, work, how much money I make, about everything about me is online now and the worst of all saying I am gay looking for a man.

I can't believe that someone can accept the terms to a contract and basically lie and get away with it???

My response:

So far, all that's been done is a violation of a TOS between her and Yahoo. So, that's between Yahoo and her. As for you, you don't have anything. You may not like what she has said and done, but unless the information places you in a "false light" AND others believe it, causing you monetary damages, then you have nothing.

There is a fine line between libel, slander and her First Amendment right of freedom of speech. And, that's the balancing act a court would have to decide.

Would you recommend contacting her and asking her why she did this or leave it alone and await the outcome from yahoo.

The deal with the personal on yahoo is you have to accept the terms of the site which states this is you and not an impersonation of someone else. I can't understand how you can use someone else's information and identity online and who knows what is being sent out?

I still can't believe that if this was printed and given out on car windshields in a parking lot you would have the pants sued off of you. But online it is anything goes and a free for all???

So basically she can state lies and get away with it?

So basically not a leg to stand on a court would have to decide other than that this whole forum is a waste of my time and you are telling me to deal with it.

Freedom of speech and so on, that is a fine line and it has been crossed but I will let it go and let Yahoo deal with it and move on.

At least I would never do that to someone or even dream of that kind of psycho type activities.
