What is the name of your state? California
Can I sue a disgruntled ex-girlfriend (aka the homewrecker) of my son's father for making a false report to social services? The accusations in the report were horrible and she truly defamed my character. The social worker wouldn't tell me who made the complaint but because of all of the info. in the complaint and the names that the police officers threw out there, it's safe for me to assume without a doubt this is the person behind the lies. She's very, very upset that my son's father wants to work things out with me for the sake of our family instead of tearing it apart and trying to live seperate lives as so many families do nowadays. I feel very violated because the info. in the report was horrible and now this report is on file with the state in case any other "incidence" should occur in my home. I'm now paranoid and feel I can't be myself in my own home because the social worker made it sound as though the next time they have to come out, the children will be taken away. I've never been in trouble with the law my entire life (I'm 33). The report was open and closed the same day due to inconclusive evidence. The only truth to it was my son's father and I have argued in our bedroom and I have thrown a cell phone or two at him in the past. My daughter divulged this info. after the social worker interrogated her. So I had to sign a paper from social services stating my remedy is to protect my children from any violence in the home and from any future substance abuse that may occur by the father (he has a record). I'm very upset that she put my family through this all because she wants to get back at my son's father. It's so wrong, it makes me sick. I want to sue her in court for this and I need to know if it's even going to be possible considering social services is protecting her or whoever's name she used to file the report. I have a feeling she used her cousins name because her cousin is now involved and tried contacting me over the phone after I called the accuser to let her know how wrong she is. All I got out of that screaming match is that she's going to get my son taken away from me and click, she hung up. This girl also has a restraining order against my son's father from a violent argument they got into when he tried to leave her back in October. She continually violates her end of the restraining order and constantly contacts him and sends him text messages trying to lure him back. Unfortunately he has also violated the order and has communicated back to her as well, which she is now using against him. Hence the police involvement.
Really is there anything I can do, I don't care if it's something that will bring a small victory, I just want her to know she can't get away with this. There has to be something that can be done or someone I can contact to get her to leave us alone and to understand you can't mess with people's lives like this. Please help.
