any help with laws or procedures regarding eviction of family. my sister and I own a home and my mother lives with us. there is no lease, no rent, only splitting of utilities. My sister and I have asked my mother to leave, this is a extremely difficult decision, but we have tried with our mother and the situation has become unbearable for us, she has medical and emotional issues. Our mother has refused to leave. What are our rights.

thanks for the help

Q: What are our rights.

A: Evict her using the landlord/tenant law. Or, you could send her out to bingo one day and, while she was gone, change the locks and change the name on the mailbox.

Sr. are you getting unbearable yourself ?

Maybe instead of the girls being ungrateful , they could call Adult Protective Services and ask . Mom might get the assistanse She needs and the girls could prevent guilt later on .

A: What do you mean "getting"? I have been unbearable for years, thank you very much.

does landlord/tenant apply?

would this be considered landlord/tenant though she has no lease/contract, and only has her own bedroom, sharing the rest of the home? If she doesn't pay rent will this affect her being tenant, or is contributing for utilities considered rent? I realize it seems cold, but it is far from a light hearted situation and we have begged and pleaded for any signs of change, she will no longer even see her psychologist which is creating more bizarre behavior. After many sleepless nights I am comfortable with being forced to do this.
Any help is appreciated.

She lives there, so she never paid any rent, you never asked her to, yes you still have to legally evict her, or the bingo thing. You are right, it does seem cold.

What exactly are you expecting your mother to do? Where will she go? Is she disabled do to her issues?

You can evict her. Give notice, in writing, per PA law. Then to court...

However, if you come up with answers to the above questions, it is far more likely she will WANT to go and you will have a mutual outcome that will not involve court.

If her behavior is dangerous (violent, illegal or self injurious) you need to call the police.
